Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of DataLeadServer (the “Company”), its website at dataleadserver.com and related services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1) Eligibility & Accounts

  • You must have the legal authority to enter into these Terms.
  • If you create an account, you are responsible for safeguarding your credentials and all activity under your account.

2) Products & License

  • Upon purchase, you receive a non-exclusive, non-transferable, revocable, internal-use license to use the data files within your organization.
  • Prohibited: resale, redistribution, repackaging, public posting, or making the data available to third parties, except with our prior written consent.
  • Unless otherwise stated, files are provided in CSV; XLSX may be available on request.

3) Acceptable Use & Compliance

  • You are solely responsible for how you use the data, including compliance with applicable laws and regulations (e.g., anti-spam laws such as CAN-SPAM, GDPR/UK GDPR where applicable, ePrivacy, local data protection rules).
  • Do not use the Services for unlawful, harmful, misleading, or abusive activity. No harassment, discrimination, or violation of privacy rights.
  • When contacting individuals, you must provide appropriate disclosures, honor opt-outs, and maintain your own suppression lists.

4) Orders, Pricing & Taxes

  • Prices, promotions, and product availability are subject to change without notice.
  • You are responsible for any applicable taxes, duties, or fees required by your jurisdiction.
  • We may refuse or cancel orders if fraud or misuse is suspected.

5) Delivery & Access

  • Standard packs are delivered by instant download or secure link. Links may be time-limited.
  • Custom lists are delivered according to the agreed specification and timeline.
  • You are responsible for promptly downloading and securely storing purchased files.

6) Samples & Previews

  • Samples are for evaluation only and may be masked or reduced.
  • We reserve the right to approve/deny sample requests at our discretion.

7) Refunds & Replacements

  • Due to the nature of data products, all sales are generally final once files are accessed or downloaded.
  • We may, at our discretion, offer a replacement or partial remedy in cases of non-delivery, duplicate charge, or material mismatch versus the advertised specification, if reported within 7 days of purchase.

8) Accuracy & Updates

We strive for accuracy, but data can contain errors or become outdated. Datasets are provided “as is” and may include fields that are not available for every record. We may update or improve datasets over time.

9) Intellectual Property

The Services, site content, branding, and data curation are protected by intellectual property laws. Except for the limited license granted above, no rights are transferred to you. Do not remove proprietary notices.

10) Third-Party Services

We may use third-party providers (e.g., hosting, analytics, email, payment gateways). Their services are subject to their own terms and privacy policies. We are not responsible for third-party actions or omissions.

11) Warranties & Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement. Your use is at your own risk.

12) Limitation of Liability

To the maximum extent permitted by law, DataLeadServer and its affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business interruption, arising out of or related to your use of the Services. In no event will our total liability exceed the amount you paid for the specific product or service giving rise to the claim.

13) Indemnification

You agree to indemnify and hold harmless DataLeadServer and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Services or violation of these Terms.

14) Governing Law & Dispute Resolution

These Terms are governed by the laws of Bangladesh (without regard to conflict of law principles). Courts located in Dhaka shall have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Services.

15) Changes to the Terms

We may update these Terms from time to time. The updated version will be posted here with the new effective date. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
